Bean bag supplier gives undertaking to ACCC

SlumberTrek Pty Ltd, the supplier of the Elmo shaped bean bag cover, has provided a court enforceable undertaking to the ACCC following concerns raised that the Elmo bean bag did not contain the required warning label:

"WARNING: Small Lightweight Beads Present a Severe Danger to Children if Swallowed or Inhaled." 

The warning label is required under a prescribed consumer product safety standard.

The undertaking provides that SlumberTrek will publish a warning notice on its website and will implement a Trade Practices Compliance Program.

Previously, the Federal Court had made orders by consent in relation to Kmart Australia supplying the Elmo bean bag without the required warning label.

SlumberTrek, in conjunction with Kmart, has recalled the product. Consumers are encouraged to return any Elmo bean bag covers without the warning label to Kmart.
